 GOSI-KSA and OWWA - Benefits Explained

GOSI - Government Organization of Social Insurance  (Social Insurance Law of KSA )

Overview - Occupational Hazards Branch (OHB) is one of the two insurance branches (of GOSI) which provides benefits in cases of employment injuries.
 
The other branch is called Annuities Branch which provides benefits in cases of non-occupational disability, old-age, and death. 
 
OHB is compulsory applied to all Saudi and non-Saudi workers
 
Exceptions are the following
1. Domestic workers / family drivers - however they are free to
be treated in a government hospital as long as they have valid Iqamas
2. Foreign workers who engage in works which usually take no more than three months.
3. for more exceptions see Article 5 of the Social Insurance Law.


Disability and Death Benefits Computation (under OHB)


Permanent Disability Benefit Computation ( if the worker's age does not exceed 40 )
- Salary multiplied by 84  (or number of months in seven years)
- but wont exceed 330,000SR
 
for example ang sahod ng isang worker ay 4000 at entitled for permanent disability benefit ang computation ay ganito.
 
4000 X 84  = 336,000   , so ang matatanggap ng worker ay 330 Thousand lang.
 
Partial Disability Benefit Computation ( if the worker's age does not exceed 40 )

- Salary mutliplied  84 (7 years) multiplied by the percentage of disability (if disability percentage is equal to 50% to 99%).

for example ang salary is 4000 Sr at ang percentage ng disability is 70 %
then
 
4000 X 84 X 70%  = 235,200SR

if the disability percentage is less 50% then
 
- Salary mutliplied  60 (5 years) multiplied by the percentage of disability (if disability percentage is less than 50%).
- note the percentage of disability must be declared by gosi at their physician. disability percentage must be 1 % to 49 % 
- but wont exceed  165,000 SR
 
for example ang salary is 4000 Sr at ang percentage ng disability is 30%
then
 
4000 X 60 X 30%  = 72,000
 
Death Benefits  ( if the worker's age does not exceed 40 )
 
Death Benefits computation is like that of Permanent Disability benefit.
- Salary X 84   but not more than 330,000SR
 
For workers above 40  years old

bawat taon na sumubra sa 40 ay ibabawas doon sa total months ng matanggap na benefits ng worker

For example ang edad ng worker na nagsuffer ng total disability or death ay 50 years old.

then 50 - 40 = 10 

so instead na  84 months na sahod , 74 months na lang.  (same for partial disability with a disability percentage equal to 50% or more)

- for partial disability with disability percentage of  less than 50%  then it will be 50 months only (60 minus 10).

condition : ang computation ay hindi bababa sa 36 months na sahod .
- lahat ng benefits entitled to a foreign worker are paid as lump sum.
 
Note :
 
Foreigners who come here with  visit visas are not covered by the Social Insurance Law (Note they can never be considered as legal workers / their passports have visas with "Not Permitted to Work" stamp).

Self inflicted disabilities and self inflicted deaths are not covered with the OHB.

Another exceptions are the Disabilities or Deaths caused by the employer towards the worker However,  Private Right of Action (for compensation) can be filed according to the Criminal Laws (Laws of Criminal Procedure).

Now let us talk about OWWA Insurance and Health-Care Program Benefits 
a. Life/Accident Insurance

A member is covered with life insurance for the duration of his employment contract. The coverage includes P100,000.00 for natural death and P200,000.00 for accidental death.
 
b. Disability and Dismemberment Benefits

A member shall be entitled to disability/dismemberment benefits ranging from P2,000.00 to P50,000.00.
 
c. Total Disability Benefit

In case of total permanent disability, a member shall be entitled to P100,000.00
 
d. Burial Benefit
A burial benefit of P20,000.00 shall be provided in case of the member's death. 


Tasyo Reactions : 


Hindi man natin pinangarap ang mga halaga ng pera na mga ito. Palagi man nating pinagdasal na malayo tayo sa kapahamakan. Minsan hindi rin maiwasan na isang kababayan or kaibigan ay makaranas ng masamang pangyayari. Minabuti po nating ipaliwanag ang mga benepisyong ito para lahat tayo ay magbabantay para sa ating mga karapatan.

sa GOSI,  ang mga  lehitimong na manggagawa ng KSA, ay halos walang binabayaran pero napakalaki na protection para sa atin. Sigurado mong makuha kung lalakarin mo.

sa OWWA, sapilitan pa, hindi ka makaalis ng Pilipinas kung di mo ito babayaran. Ang nakakalungkot, pahirapan pa para makakuha ng benefits.

25USD ba kamo?  ilang milyong Pilipino umaalis ng Pilipinas taun-taon? 

kahit sasabihing isang milyon na lang, eh di 25 milyon yon, di ba ? DOLYAR PA..

teka ilang milyon nga ba tayo OFWs lahat ?

- Naawa pa rin ako sa mga kababayan na local hire dyan sa POLO-OWWA. Lalo na yong mahigit isang dekada na nagtrabaho. wala silang GOSI. Wala rin silang benepisyo katulad ng mga staff na pinadala galing sa Pilipinas.  Pero kung iisipin nating mabuti, these local hires are OFWs din. OFWs na pinili magtrabaho sa gobyerno natin para tumulong ng kababayan. Kailan kaya maawa ang DOLE, POEA at OWWA sa kanila no? 

"Mao ni Lisod sa mga nakaposition ug taas sa gobyerno. Di kahibalo mohuna-huna. Way mga konsensya. Loog ug kasing-kasing. Pero kung mawala na sa pwesto, aw palooy-looy dayon..Mura pa ug true kunuhay ang luha. Arang ka itom diay ang muta.  Da uroy Ninyo!"

1. yong accident na nangyari sa pagtravel ng isang worker mula bahay papunta sa work or vice versa ay considered as occupational injury at entitled sa mga benefits ng GOSI na nakasulat sa taas.

2. yong mga undocumented (run-aways) ay hindi covered ng Social Insurance Law.

The Saudi Government requires all companies and their workers to have a Social Insurance  (GOSI). 

Kung ikaw ay isang legal na manggagawang filpino ng Saudi Arabia, mabuti ay alamin mo kung ang company mo (or ikaw mismo) ay miyembro ng GOSI. 

May ilan ng company ang hindi makakuha ng visa dahil napatunayan na hindi sila nagprovide ng medical insurance and GOSI sa kanilang workers.

The Kingdom is working on a plan which will ensure that no expatriate will receive a valid residence permit without subscribing to the social insurance system.

The move will help to provide social security benefits to a growing number of expatriates who have been working mainly in the private sector companies.

The move will help to provide benefits to the insured workers in cases of deaths or disabilities on account of injuries while on duty and occupational diseases.

The new plan will cover nearly seven million expatriates currently working in Saudi Arabia. Until now, the insurance coverage under the General Organization for Social Insurance (GOSI) has not been made mandatory on all expatriate workers.

The GOSI, however, has stepped up its efforts to provide social security benefits to the foreign workers.

The GOSI, according to a report released by this social insurance organization, has already covered millions of workers in over 19,000 small enterprises, medium-size companies and big companies. These companies are currently operating in various parts of the country.

The report said that more than 20 million beneficiaries, including Saudis and expatriates, have already received social security benefits from GOSI.

Under GOSI’s current social security scheme, Saudi workers are entitled for monthly pension benefits and refund of their contributions, whereas expatriates are only entitled to occupational hazard benefits.

Referring to the GOSI’s services, the report said that this social insurance body is also a member of the International Social Security Association (ISSA), which appointed GOSI to undertake the huge task of translating, publishing and distributing the International Social Security Review (ISSR), which contains updated social security reports, surveys and research materials.

All these services offered by the GOSI comes in line with the directives of the Saudi government, which is genuinely interested in the welfare of its citizens and its expatriate workers. The GOSI, the report said, seeks to ensure protection under the social insurance act, which calls for benefits to be extended to the Saudi workers suffering from temporary disabilities, sickness and maternity.

It also offers other benefits to Saudi and foreign workers within the framework of its provisions.

It also covers the cost of medical treatment, offers compensation for partial or permanent disabilities, marriage grants and funeral expenses. The GOSI, an entity enjoying technical and administrative independence, has set up more than 17 chapters in various parts of the country.
